Zoning board backs rezoning for Paines Avenue house above current size limit

The Nov. 5 recommendation is not final approval. Staff proposed a 35-foot height cap, but the marked agenda does not specify the board’s conditions.

Atlanta’s Zoning Review Board recommended conditional approval Nov. 5 for rezoning 361 Paines Avenue NW, where a proposed single-family house exceeds the property’s current floor-area limit.[1][2]

The marked agenda records the board’s recommendation for case Z-26-53 but does not spell out its conditions. The recommendation is not final rezoning approval.[1]

We previously reported planning staff’s support for the proposal. Staff recommended restricting development to a detached single-family house no taller than 35 feet. The marked agenda does not establish whether the board adopted those exact restrictions.[1][2]

The size issue concerns the existing maximum floor-area ratio of 0.50. Staff says the vacant property has potential economic use under its current zoning; the requested change would accommodate this particular house, rather than make an otherwise unusable lot buildable.[2]

The request would move the property from Subarea 1 to Subarea 2 of the English Avenue Special Public Interest District while retaining the Westside Affordable Workforce Housing Overlay. Staff also says a separate change to the 2025 Comprehensive Development Plan is required, from Medium Lot Single Family to Low Density Residential.[1][2]

The paperwork discrepancy we reported earlier is not resolved by the marked agenda: the ordinance and board listing name Subarea 2 as the destination, while the housing impact statement names Subarea 3.[1][3]
