Chattahoochee Hills’ 2024 rezoning returned 1,606 acres to rural status

Chattahoochee Hills adopted a zoning reversal on March 5, 2024, returning 1,606.18 acres from Mixed-Use Hamlet to Rural zoning. Ordinance 24-03-271 took effect upon adoption. It identifies Painted Rock Farm, LLC as the property owner; the attached legal description places portions of the tract along Jones Ferry Road and the east bank of the Chattahoochee River.

The action reversed a 2023 rezoning. That earlier approval allowed Council to consider reverting the zoning if the sale to the applicant did not close by year-end or if development or building permits were not issued within 24 months, whichever came first. The 2024 ordinance says the sale did not close by year-end and no such permits had been issued.

The ordinance also eliminated three variances. Those allowances had increased the permitted off-site share of required open space from 20% to 50%, removed a minimum residential density of half a unit per acre, increased the maximum nonresidential share of developable land from 25% to 100%, and waived thoroughfare requirements in portions with restricted public access.
