Macedonia Road plan seeks to tie commercial-buildout deadline to apartment occupancy

The applicant behind the 242-apartment proposal at 2761 Macedonia Road wants to change when its commercial space must be completed. A Sept. 10 Powder Springs staff report describes an alternative that would permit at least 5,000 square feet of commercial space concurrently with the apartments, while withholding occupancy certificates beyond half the apartments until the first-floor commercial shell receives its certificate of occupancy.

Under the existing sequence described by staff, all 5,000 square feet of commercial space would need a building permit and certificate of occupancy before building permits could be issued for more than 121 of the 242 apartments. The proposed substitute would move that checkpoint from apartment building permits to apartment occupancy and specify commercial-shell completion.
