Up, not out: East Avenue addition gets staff backing

Planners recommend the setback exception for the Old Fourth Ward home, saying the second floor would preserve its footprint. The zoning board hearing is scheduled for Nov. 5.

Atlanta planning staff recommends approving a setback exception for a second-story addition at 547 East Avenue NE, saying the home would grow upward without expanding its footprint.[1]

That resolves a key unknown in our earlier report on the proposal. The request would reduce the required “half-depth front yard” setback from 15 feet to 3.8 feet, but staff says the extra living space would sit above the existing structure rather than extend farther into the surrounding yards.[1]

The Old Fourth Ward corner property, at East Avenue and Prospect Place, has about 5,000 square feet of land and 40 feet of frontage along East Avenue—2,500 square feet and 10 feet short of the zoning district's respective minimums. Staff says the lot's dimensional constraints and established development pattern would make strict application of the rules an unnecessary hardship.[1]

The plan also calls for removing an accessory shed that encroaches into the required yard. Staff concludes the variance would not harm neighboring properties' access to light or air or create emergency-access and fire-safety risks.[1]

The recommendation is not permission to build. Case V-26-142 is scheduled for the Board of Zoning Adjustment's Nov. 5 meeting at noon in the second-floor Council Chambers; the supplied records establish staff support, not a board decision.[1][2]
