Council approves $30,000 settlement over alleged sexual contact by APD officer

The 10–0 vote authorizes settling claims against Atlanta and its employees. The city attorney says the potential financial exposure exceeds the settlement amount.

Atlanta City Council voted 10–0 on Nov. 2 to authorize a $30,000 settlement of Danielle Mathis’s claims against the city and its employees. The lawsuit alleges nonconsensual sexual contact by an Atlanta police officer at a Summerhill Publix, according to the resolution and the council’s draft action minutes.[1][2]

The vote moves the measure beyond the committee recommendation we reported Oct. 27. The Public Safety & Legal Administration Committee had backed the substitute resolution 5–0 on Oct. 26.[1][2]

The resolution says Mathis alleges Officer John Jones subjected her to the contact on Aug. 16, 2024, causing humiliation, fear, anxiety and mental and physical distress. The settlement authorization is not a finding that the alleged conduct occurred.[1][2]

The city’s stated rationale is financial risk. The resolution says the city attorney reviewed the facts and law and determined that Atlanta’s potential financial exposure in defending the claims exceeds $30,000. It also says Mathis agreed to accept that amount to settle her claims against the city and its employees.[2]

Resolution 26-R-4319 authorizes payment from the general fund’s litigation-expense account in exchange for dismissal of claims against Atlanta and its employees. It does not authorize settling claims against Publix, which is also named as a defendant.[1][2]

The minutes record Council approval, not a completed payment or court dismissal. Those steps are not established by these records.[1][2]
