Atlanta incentive-withholding proposal would respect existing contract limits

Atlanta's held proposal to withhold economic-development incentives from tax-delinquent recipients would apply to existing agreements only as permitted by law and their contract terms. Resolution 26-R-3938 expressly says it would not create, modify or impair contractual, vested-property or statutory rights.

The request includes data-center projects but is not limited to them. It asks city agencies to review tax compliance before approving, renewing, extending or disbursing city incentives, and seeks a policy withholding benefits while a project or operator owes delinquent city taxes or other legally required payments.

The Finance/Executive Committee kept the resolution held Sept. 30, with Oct. 5 at 1 p.m. listed as the next checkpoint. These remain proposed policies, not enacted eligibility rules.
