Council votes to pay up to $159,464 for software services after contract expired

The 15–0 Council vote covers past e-Builder services—not a renewal of the expired contract. The records do not establish that the bills have been paid.

The contract ended; the software services continued. Atlanta City Council voted 15–0 on Oct. 19 to authorize up to $159,464.29 in payments to e-Builder for construction-project-management software services under an expired Transportation Department agreement.[1][2]

As described in our report on the committee recommendation, the agreement’s final renewal ended May 30, 2025. The ordinance says e-Builder continued providing services afterward.[2]

Amended ordinance 26-O-1558 addresses those outstanding bills without bringing contract FC-9878 back to life. It ratifies past services and approved unpaid invoices, and expressly rules out extending, renewing or reactivating the agreement—or authorizing future services beyond work already performed and invoiced.[2]

For ongoing service, the amended text points to a separate arrangement: an Oct. 5 Council ordinance authorizing the Transportation Department to become a user of another e-Builder agreement.[2]

The payment measure lists the TSPLOST II capital-project fund and a Safety and Mobility account in the Capital Finance Fund as funding sources. It does not divide the payment ceiling between them.[2]

The ordinance does not itemize the invoices, specify their service dates or explain why services continued after expiration. Council adoption is established; mayoral approval of the measure and actual payment of the bills are not established in the records reviewed.[1][2]
