Atlanta’s Transportation Committee voted 5-0 on Oct. 14 to recommend the city’s acknowledgment of Spirit’s airport lease assignment to Delta. Full City Council review is listed for Oct. 19 at 1 p.m.[1][2]

Behind that signoff is a $12 million agreement covering preferential-use gates C4 and C6 at Hartsfield-Jackson, plus ticketing-lobby and support space. The lease runs through June 30, 2031. The agreement calls for Delta to pay Spirit the assignment fee, including costs to cure lease defaults—not for Atlanta to buy two gates.[3]

The committee recommendation is not final municipal consent. Resolution 26-R-4262 would authorize the mayor or a designee to execute documents acknowledging the assignment for the remaining lease term; it does not negotiate a new $12 million deal.[1][2][3]

Spirit’s June bankruptcy motion explains why it sought the handoff: the airline said it no longer needed the space because it was winding down operations. Assigning the lease would bring money into its bankruptcy estate and stop the associated costs, Spirit argued.[3]

Even after authorization, the city’s acknowledgment documents would not bind Atlanta until mayoral execution, municipal clerk attestation, legal approval and delivery to both airlines.[2]

The underlying transaction’s timing remains unresolved in the records reviewed. The city’s proposed resolution describes a court-approved assignment effective June 9. But the agreement attached to Spirit’s June 17 motion identifies June 9 as its execution date and makes effectiveness conditional on an approving court order. The entered order, actual effective date and payment have not been verified.[2][3]
