Farm House Heritage Park’s fine print: sewer access comes first

An agreement returning to Alpharetta council Oct. 19 lets the city build in a sewer easement—but Fulton County keeps access and removal rights.

Park improvements can go inside Fulton County’s sewer easement at Farm House Heritage Park, but they cannot cut off the county’s access. The signed agreement returning to Alpharetta City Council on Oct. 19 also lets Fulton terminate the license and remove those improvements without paying for their loss or damage.[1]

The agreement concerns the park site at 0 Morris Road and was required before construction could begin, according to the city’s staff report. Staff says council originally approved it June 1, but “minor changes” were needed after the city signed and before Fulton County considered it. The city attorney recommended bringing it back for ratification. The report does not identify the revisions.[1]

An attached drawing marks where an elevated structure overlaps the sewer easement. County crews retain access across the improvements for routine maintenance and emergency repairs. If Fulton exercises its removal right, the agreement requires it to avoid damaging or disturbing other portions of the city’s property.[1]

The staff form lists no fiscal impact for the ratification, but the agreement assigns future responsibilities: Alpharetta must maintain, repair and replace the improvements. It must also repair utilities damaged by the city, its employees or subcontractors, or by failure of the improvements. Fulton can perform those utility repairs and charge the city.[1]

This is ratification, not the agreement’s first signing: the attachment bears city and county signatures and an Oct. 1 recording stamp. The removal clause is a contractual right, not an announcement that improvements will be removed. These records do not establish whether park construction has begun.[1]

The ratification is on the Oct. 19 consent agenda. Council meets at 6:30 p.m. in the City Hall council chambers, 2 Park Plaza; the upcoming vote remains unresolved.[1]
